Terms and conditions
These terms are the agreement between Khatwa Labs for Digital Solutions, which operates Kartaak, and the business using it. By creating an account you accept them. If you are accepting on behalf of a company, you confirm you are allowed to.
If you hold a loyalty card from a shop, these terms are not for you. Your card is between you and that shop, and what happens to your data is in the privacy policy.
What we provide
Kartaak lets you design a loyalty card, issue it to your customers through Apple Wallet and Google Wallet, record stamps and rewards at your counter, and, on a paid plan, send messages to the cards you have issued.
We are early. We do not promise a particular level of uptime, and we do not offer a service credit for interruptions. We will tell you about planned work that will interrupt the service, and we will not knowingly leave it broken.
Your account
- Kartaak is for businesses. It is not for personal use.
- Keep your sign-in details to yourself. Anything done through your account is treated as done by you, so give staff their own logins and remove them when they leave.
- Give us accurate details, and keep them up to date.
Plans and payment
- The free plan has no time limit and needs no payment details. We may change what it includes, and we will tell you before we do.
- Paid plans are billed monthly in advance in Egyptian pounds. Prices shown exclude any tax that applies.
- New accounts may be given a period of a paid plan at no charge. When it ends the account returns to whichever plan it is actually on, and features above that plan stop. Nothing is charged automatically at the end of a free period.
- If a payment fails we will try again and tell you. If it keeps failing the account moves down to the free plan rather than being deleted.
- Refunds are covered separately in the refund policy.
Your customers’ data is yours to answer for
When your customers save your card, you decide what happens to their data and we hold it on your instructions. In data protection terms you are the controller and we are your processor. That means:
- You must have a lawful reason to collect it, and must not use it for anything your customers were not told about.
- You may only send offers to customers who agreed to receive them. Our system records who agreed and who did not, and you must respect it.
- If a customer asks you to correct or delete their data, you must act on it, and we will give you the tools to.
- We will not use your customers’ data for our own purposes, and we will not sell it.
What you upload
You keep ownership of your logo, artwork and wording. You give us permission to use them only to run your account: to render your card, to display it in a wallet, and to show it back to you.
You confirm that you own what you upload or have permission to use it. Do not upload anybody else’s logo, photographs you do not have a licence for, or artwork taken from the internet. If somebody complains that your artwork is theirs, we may remove it, and you are responsible for the consequences.
Things you must not do
- Use Kartaak to send messages to people who did not agree to receive them.
- Issue cards for a business you do not run, or pretend to be somebody else.
- Stamp cards fraudulently, or use the service to run anything unlawful.
- Attempt to break, overload or reverse engineer the service, or get at data belonging to another shop.
- Resell Kartaak as your own product without a written agreement with us.
Suspending or closing an account
You can close your account at any time from your settings, or by writing to us. We can suspend or close an account that breaks these terms, that is being used unlawfully, or where payment has failed repeatedly. Except where something is seriously wrong, we will warn you first and give you a chance to put it right.
When an account closes, the cards it issued stop updating. Ask us before you close it if you want a copy of your customer list.
Where responsibility ends
We are responsible for running the service with reasonable care. We are not responsible for the rewards you promise your customers, for what you write to them, for a customer losing their phone, or for Apple or Google changing how their wallets work.
Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited under Egyptian law. Beyond that, our total liability to you for any claim is limited to what you paid us in the twelve months before the claim arose, and we are not liable for lost profits or lost business.
Changes to these terms
We may change these terms. If a change materially affects you we will tell you before it takes effect, and continuing to use Kartaak after that means you accept it. If you do not, you can close your account.
Which law applies
These terms are governed by the laws of Egypt, and the courts of Egypt have jurisdiction over any dispute.
